These are the general Terms and Conditions governing your access and use of the content and service (the “Service”) offered to you on this website (the "Site"). This Site and the Service are operated by or on behalf of Vodafone Group Plc, whose registered address is at Vodafone House, the Connection, Newbury RG14 2FN (referred to as “we”, “us”, “our” or “Vodafone”). Please read these Terms and Conditions carefully. If you do not agree with them, you should not proceed any further on the Site. By accessing this Site and continuing to use the Site and/or the Service, you agree to be bound by these Terms and Conditions. Vodafone may revise these Terms and Conditions from time to time and where possible, we will provide notice of such changes on the Site. Any changes shall become effective two weeks after being posted on the Site. By continuing to use the Site you will be deemed to have accepted the revised Terms and Conditions. You should therefore check these Terms and Conditions each time you access the Site. You should also refresh your browser each time you visit the Site and the Service to ensure that you download the most up to date version of the Site and the Service.

1. Your use of the Site’s content

1.1 It is your sole responsibility to satisfy yourself prior to using the Site and the Service in any way that they are suitable for your purposes and up to date.

1.2 You acknowledge and agree that you are only permitted to use the Site and the Service as expressly set out in these Terms and Conditions or on the Site.

1.3 You acknowledge and agree that all text, artwork, videos, graphics, logos, symbols, data, applications, information, software and other material or moving images contained in or accessible on the Site (“Content”), whether presented to you by Vodafone, by the Site’s users, by other licensors or by any other third party are protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. All rights are expressly reserved.

1.4 Unless expressly specified in respect of a particular item of Content, you are only allowed to view and use the Content via your PC, mobile telephone or other access device for private, non-commercial purposes only and subject to your strict compliance with these Terms and Conditions. You may copy the Content in an unchanged form for private use on your own PC, mobile phone or other access device if and to the extent that such copying is required for the proper use of the Content and such copying is permitted by the copyright owner. If you wish to do anything else with any of the Content, you must first obtain the written permission of the owner of the rights in that

1.5 Any use of caching, http accelerators such as Harvest, Squid, Netscape proxy or Microsoft Catapult, or similar technology is permitted, however, you have the responsibility of ensuring you are viewing the most recent version of the web-page on content.

1.6 You may establish a link or "deep link" to the Site from your site, provided that you have obtained Vodafone’s prior written consent and that in Vodafone’s sole discretion, the context is relevant and the link or its description is not detrimental to Vodafone.

2. Prohibited use of the Site, the Content and/or the Service

2.1 You are responsible for any misuse of the Service or the Content even if it is by another person using your access to the Service.

2.2 You must not (and shall not authorise or permit others to):

  • copy, disclose, modify, reformat, display, distribute, licence, transmit, sell, perform, publish, transfer or otherwise make available the Content and/or the Service (or any part thereof)or any information learned by you whilst using the Service or accessing the Site;
  • remove, change or obscure in any way anything on the Site and/or the Service or otherwise use any material obtained whilst using the Site and/or Service except as set out in these Terms and Conditions;
  • reverse engineer or decompile (whether in whole or in part) any software used in the Site and/or the Service (except to the extent expressly permitted by the applicable law);
  • use any part of the Site, the Content, and/or the Service for any commercial purpose;
  • Include or create links (including deep-links) to or from the Site, unless authorised to do so by Vodafone (please see paragraph 1.6 above).
  • remove, obscure or change any copyright, trade mark or other intellectual property right notices contained in the original material or from any material copied or printed from the Site or obtained a result of the Service.
  • use the Site and/or the Service for any illegal purposes or in breach of any applicable laws, statutes and regulations or codes or practice;
  • use the Site and/or the Service to upload, post (please see paragraph 3 “Posting and uploading Content on the Site” below for more details) or otherwise access or transmit any unlawful or objectionable materials such as obscene, pornographic, threatening, racist, menacing, offensive, defamatory content, content in breach of confidence or in breach of any intellectual property right (including copyright);
  • harass, stalk, threaten, impersonate or otherwise violate the rights of others including rights of privacy;
  • collect and process others’ personal data except in accordance with applicable data protection law;
  • infringe any other person’s intellectual property rights, including copyright;
  • circumvent user authentication or security of any host, network or account (referred to as "cracking " or "hacking") nor interfere with service to any user, host or network (referred to as "denial of service attacks") nor copy any pages or register identical keywords with search engines to mislead other users into thinking that they are reading Vodafone’s legitimate web pages (referred to as "page-jacking") or Users who violate systems or network security may incur criminal or civil liability and Vodafone will at its absolute discretion fully co-operate with investigations of suspected criminal violations, violation of systems or network security under the leadership of law enforcement or relevant authorities;
  • use the Site and/or the Service to advertise or offer to sell any goods or services for any commercial purpose without Vodafone’s written consent;
  • knowingly or recklessly transmit any electronic Content (including viruses) through the Site and/or the Service which shall cause or is likely to cause detriment or harm, in any degree, to computer systems owned by Vodafone or other Internet users;
  • hack into, make excessive traffic demands, deliver or forward chain letters, "junk mail" or "spam" of any kind, surveys, contests, pyramid schemes or otherwise engage in any other behaviour intended to inhibit other users from using and enjoying the Site and/or the Service or any other web site, or which is otherwise likely to damage or destroy Vodafone’s reputation or the reputation of any third party;
  • use the Service or the Content in any way that we in our sole and absolute discretion consider objectionable, inappropriate, likely to injure our brand and reputation or otherwise unacceptable.

2.3 Please notify us as soon as possible if you become aware of any misuse of the Service or any objectionable content by emailing full details to “receiver[at] vodafone.com” or using the “Report this Post/Report Inappropriate Content ” button on the relevant webpage. We will respond to the complaint as soon as we can, and will remove or delete any Content that we consider may be offensive, illegal, violate the rights, harm or threaten the safety of any person, or which is in any other way inappropriate.

3. Posting and uploading Content on the Site

3.1 In order to access some features of the Site, in particular posting and uploading content, you will have to register and create a Vodafone Receiver account. When creating your account, you must provide accurate and complete information. It is important that you keep your password secure and confidential. You must notify Vodafone immediately of any breach of security or unauthorised use of your account that you become aware of.

3.2 You agree that you will be solely responsible (to Vodafone and to others) for all activity that occurs under your Vodafone Receiver account. You are in particular solely responsible for the content that you post on the Site or through the Service and the consequence of posting or publishing such materials and/or information. Vodafone does not endorse and has no control over any comment, opinion, recommendation, or advice expressed therein.

3.3 You represent and warrant that you have (and will continue to have during your use of the Service) all necessary licenses, rights, consents, and permissions which are required to enable Vodafone to use your comment(s) for the purposes of the provision of the Service by Vodafone and otherwise to use your comment(s) in the manner contemplated by the Site and these Terms & Conditions.

3.4 You further agree that you will not (a) submit material that is subject to third party proprietary rights unless you have permission from the rightful owners, (b) that you will not submit material that is in breach of confidence or is obscene, pornographic, threatening, racist, sexist, menacing, offensive, defamatory, in breach of confidence or is otherwise unlawful or objectionable, (c) publish false or misrepresented information that could damage Vodafone or any third party, (d) post advertisements, or (e) impersonate others. Please familiarise yourself with the contents of the Blog Netiquette, which you agree to observe.

3.6 We reserve the right to remove, edit or refuse to post any material that you or other third parties place or attempt to place on the Service, to block or suspend your access to the Service and to take such other action as we in our sole and absolute discretion consider necessary to prevent or remedy any breach of these Terms. Please notify us of any Content or third party material or activity on the Service that you reasonably believe is in breach of these Terms by following this Link. We are not responsible for any failure to remove, or delay in removing, any Content or third party material from the Service or for any good faith but wrongful removal of third party material.

3.7 We will also co-operate with law enforcement and other relevant authorities with respect to any investigation or violation of network security and reserve the right to disclose any information (including personal data) derived from you as required by law or in the good faith belief that failure to comply with a legitimate request from a law enforcement agency would be likely to prejudice the prevention or detection of crime or the apprehension or detection of offenders.

3.8 You will be required to accept the terms of our online licence before uploading an article or artwork.

4. Downloading Content

4.1 Where it is expressly stated on the Site that certain material is available for download, we grant you a non-exclusive, non-transferable, royalty-free licence to download that material and use it only for your own personal home use.

4.2 Where any of our Services enable you to download Content to a PC, mobile phone, personal digital assistant or other access device you must comply with the following conditions:

4.2.1 You may save such Content on your access device but (unless expressly permitted) you are strictly prohibited from saving such Content elsewhere; editing or modifying the Content; copying, distributing or forwarding the Content to one or more third parties or allowing third parties to access it.

4.2.2 You should adjust the personal settings on your access device to ensure that you receive the Content that you have selected. By registering for Services you confirm that your access device can support the downloading of the relevant Content. If you are unsure whether this is the case you should check the information on this Site, consult your handbook or contact the manufacturer of your access device. We cannot be held responsible should you attempt to download Content onto an incompatible access device and you will be charged regardless.

4.3 Without limitation, we shall not be liable in any way for failures, defects or delays in the delivery of the Content which are caused by one or more of the following reasons:
(a) your message mail box is full and cannot receive additional messages;
(b) you have provided an incorrect phone number or other incorrect information before ordering the Content;
(c) your phone is switched off, out of range or for some other reason cannot be reached; or
(d) any other reason outside our reasonable control.

4.4 Due to the inherent risks in using the Internet, we cannot be liable for any damages to, or viruses that may infect your computer equipment or other property when downloading any Content. Please refer to paragraph 10.3 below for more details.

5. Your Privacy

Vodafone’s usage of your personal information is governed by the Vodafone Group’s Privacy Policy Statement (link to privacy policy at the foot of this page), which forms part of these Terms and Conditions.

6. Proprietary rights

6.1 You acknowledge and agree that the Services and the Site or any part thereof, whether owned by Vodafone, Vodafone group companies, advertisers or any third party are protected by copyrights, trade marks, service marks, patents, or other proprietary rights and laws. All rights are expressly reserved by their owners.

6.2 All Trade Marks used on the Site and/or the Service are the trade marks of Vodafone or one of the Vodafone Group companies. You shall not use the Trade Marks without the prior written approval of Vodafone. Notwithstanding the generality of this clause 6.2, you will not use the Trade Marks, whether design or word marks: (1) as or as part of your own trade marks; (2) in a manner which is likely to cause confusion; (3) to identify products to which they do not relate; (4) to imply endorsement or otherwise of products or services to which they do not relate; or (5) in any manner which does or may cause damage to the reputation of Vodafone or the Trade Marks

6.3 All copyright contained in, or used on, the Site and/or the Service belongs to Vodafone, one of the Vodafone Group companies or their respective licensors. You shall not use any copyright material contained in, or used on, the Site and/or the Service without the prior written approval of Vodafone or the respective owner of that copyright.

6.4 You are only allowed to use the Site and the Services as set out in these Terms and Conditions and nothing on the Site and/or the Services shall be construed as conferring any licence or other transfer or rights to you of any intellectual property or other proprietary rights of Vodafone, any member of the Vodafone Group or any third party, whether by estoppel, implication or otherwise.

7. Costs

7.1 Use of the Site is currently free. However, Vodafone reserves the right to charge for access to part or all of the Site in the future, subject to giving you clear notice when entering any part to which charges apply. Some services may be chargeable as indicated on the Site and in any accompanying terms and conditions.

7.2 You will need to provide all equipment necessary to access the Site and the Service on the Internet and be liable for the payment for the local telephone call charges at the rates published by the telephone operator with whom you make your local calls or any other Internet access charges to which you may be subject. If your equipment does not support relevant technology including but not limited to encryption you may not be able to use certain Service or access certain information on the Site.

8. Liability for content

8.1 The Content on this Site is provided on an "as is" basis. Although every effort has been made to provide accurate information on these pages, neither Vodafone, nor any of its employees, nor any member of the Vodafone Group, their suppliers, nor any of their employees, make any warranty, expressed or implied, or assume any legal liability (to the extent permitted by law) or responsibility for the suitability, reliability, timeliness, accuracy or completeness of the Content or any part thereof contained on the Site or the Service.

8.2 You acknowledge that Vodafone is unable to exercise control over the security or subject matter of Content passing over the Site or via the Service and Vodafone hereby excludes all liability of any kind for the transmission or reception of infringing Content of whatever nature.

9. Liability for third party content

9.1 The Site contains links to the web sites, web pages, products and services also operated by Vodafone or the Vodafone Group and you agree that your use of each web site, web page and service is also subject to the terms and conditions, if any, contained within each website or web page or attached to any products or services. These Terms and Conditions shall be deemed to be incorporated into each set of terms and conditions. In the event that there is any conflict, the terms and conditions contained with the relevant website or webpage or attached to the relevant products or services shall prevail over these Terms and Conditions.

9.2 Vodafone assumes no responsibility for and does not endorse unless expressly stated, Content created or published by the Site’s users or by any other third parties that is included in the Site and the Service or which may be linked to and from the Site.

9.3 The Site and/or the Service may be used by you to link into other websites, resources and/or networks worldwide. Vodafone accepts no responsibility for the Content, services or otherwise in respect of these and you agree to conform to the acceptable use policies of such websites, resources and/or networks.

9.4 Subject to Clause 12 you agree that Vodafone does not generally and is not required to monitor or edit the use to which you or others use the Site and the Service or the nature of the Content and Vodafone is excluded from all liability of any kind (to the extent permitted by law) arising from the use of the Service, and in particular but without limitation to the foregoing, the nature of any Content. Notwithstanding the foregoing, Vodafone reserves the right to edit, bar or remove any Service and/or Content, at any time as Vodafone in its sole discretion believes to be necessary in order to prevent any breach of these Terms and Conditions or any breach of applicable laws or regulations.

10. Exclusion of liability

10.1 Nothing in these Terms and Conditions shall act to limit or exclude Vodafone’s liability for death or personal injury resulting from Vodafone’s negligence, fraud or any other liability, which may not by applicable law be limited or excluded.

10.2 Vodafone shall use its reasonable endeavours to ensure the maintenance and availability of the Site and the Service but availability may be affected by your equipment, communication networks, too many people trying to use communication networks or the Internet at the same time or other causes of interference and may fail or require maintenance without notice.

10.3 Due to the inherent risks in using the Internet, we cannot be liable for any damages to, or viruses that may infect your computer equipment or other property when using or browsing the Site, using the Service or when downloading any Content and neither we nor any member of the Vodafone Group shall be liable for any loss, claim, damage or any punitive, indirect, incidental or consequential damages of any kind (including but not limited to lost profits or lost savings or loss or corruption of data), whether based in contract, tort, strict liability or otherwise, which arises out of or is in any way connected with : (1) any use of the Site, the Service or the Content; (ii) any failure or delay in the use of or inability to use any component of the Site, the Service or the Content; and (iii) any other information, software, products, services and related graphics obtained through the Site or the Services in all cases even if we have been forewarned of such loss or damage.

10.4 All conditions or warranties which may be implied or incorporated into these Terms and Conditions by law or otherwise are hereby expressly excluded to the extent permitted by law.

10.5 Your only remedy under these Terms and Conditions is to discontinue using the Site and the Service.

10.6 Vodafone makes every effort to ensure the security of your communications. You are however advised that for reasons beyond our control, there is a risk that your communications may be unlawfully intercepted or accessed by those other than the intended recipient. For example, your communications may pass over third party networks over which we have no control. The Internet is not a secure environment. Unwanted programs or material may be downloaded without your knowledge.

11. Indemnity by you

11.1 You agree to fully indemnify and to hold Vodafone harmless from and against any claim, losses, costs, proceedings, damages, expenses (including reasonable legal costs and expenses), or liabilities, whatsoever suffered or incurred directly of indirectly by Vodafone as a result of your use of the Site and the Service in breach of any of these Terms and Conditions.

12. Monitoring/recording of communications

Monitoring or recording of your calls, emails, text messages or other communications may take place in accordance with the law, and in particular for Vodafone’s business purposes, such as for quality control and training, to prevent unauthorised use of Vodafone’s telecommunication systems and to ensure effective systems operation and in order to prevent or detect crime.

13. Suspension and termination of Service

13.1 Vodafone may elect to suspend, vary or terminate the Site and the Service immediately and without prior notice at any time for repair or maintenance work or in order to upgrade or update the Site and the Service or for any other reason whatsoever.

13.2 Vodafone may elect to terminate the Service or your access to the Site forthwith on breach of any of these Terms and Conditions by you, or if Vodafone ceases to offer the Site and the Service for any reason whatsoever.

14. General

14.1 Governing Law and Jurisdiction - These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales and you hereby submit to the non-exclusive jurisdiction of the English courts.

14.2 Severability - These Terms and Conditions are severable in that if any provision is determined to be illegal or unenforceable by any court of competent jurisdiction such provision shall be deemed to have been deleted without affecting the remaining provisions of these Terms and Conditions.

14.3 Waiver - Vodafone’s failure to exercise any particular right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Vodafone in writing.

14.4 Representations - You acknowledge and agree that in entering into these Terms and Conditions you do not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to these Terms and Conditions or not) other than as expressly set out in these Terms and Conditions as a warranty. Nothing in this Clause shall, however, operate to limit or exclude any liability for fraud.

14.5 Assignment - You in entering into these Terms and Conditions undertake that you will not assign, re-sell, sub-lease or in any other way transfer your rights or obligations under these Terms and Conditions or part thereof. Contravention of this restriction in any way, whether successful or not, will result in the Service being terminated by Vodafone forthwith. Vodafone may assign these Terms and Conditions in whole or in part to any third party at its discretion.

14.6 Rights of Third Parties - A person who is not a party to this Agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any Clause of this Agreement.

14.7 Force Majeure - Vodafone shall not be liable in respect of any breach of these Terms and Conditions due to any cause beyond its reasonable control including but not limited to, Act of God, inclement weather, act or omission of Government or public telephone operators or other competent authority or other party for whom Vodafone is not responsible.

15. Definitions

"Content"
means all data, information, material and content, including but not limited to text, pictures, photographs, software, video, music, sound and graphics;

"Service"
means the services that we are providing to you via the Site consist of the Content and the Functionalities available on the Site or otherwise provided to you as a result of your use of the Site;

"Functionalities"
means the services offered on or via the Site;

"Terms and Conditions"
means the contract between Vodafone and you incorporating these terms and conditions;

"Trade Marks"
means the word or mark "Vodafone", however represented, including stylised representations all associated logos and symbols and combinations of the foregoing with another word or mark;

"Vodafone"
means Vodafone Group Plc, whose registered office is at Vodafone House, The Connection, Newbury, RG14 2FN, England and may also be referred to as "we" or "us" in these Terms and Conditions;

"Vodafone Group"
means Vodafone Group Plc and any company or other entity in which Vodafone Group Plc owns (directly or indirectly) more than 15% of the issued share capital;

"you"
means the visitor to the Site that enters into these Terms and Conditions (and "your" shall be construed accordingly).
